Privacy Policy

This explains what we collect and how we use it. ClaimGuard is operated by JKISS LLC.
What we collect
- Account info: your email and a hashed password; optional company name, MC/DOT.
- Carrier identity verification: MC/DOT numbers and the company-identity details we retrieve from public FMCSA records to confirm we are working for the correct entity.
- Claim info: carrier and broker details, load/rate-confirmation data, dock-in/out times, amounts, and documents you upload (rate cons, BOL/POD, gate/check-in records, invoices, photos).
- Recovery communications: records of demands, follow-ups, settlement discussions, and related correspondence with brokers/debtors made on your behalf.
- Usage data: standard analytics (page views, events) to operate and improve the service.
How we use it
- To provide the accounts-receivable recovery service — including acting as your agent to contact brokers, prepare demands, process settlements, and receive and remit funds on your behalf.
- To verify submitted information, claim details, carrier authority, broker information, payment status, and supporting documentation through brokers, shippers, receivers, consignees, factors, lenders, assignees, FMCSA records, public records, payment records, and other relevant sources before and during recovery. We may rely on FMCSA records, SAFER records, public filings, and other reasonably reliable business records unless you show such information is materially inaccurate.
- To process claims, account for recovered funds, and communicate with you.
- To operate, secure, and improve the site, and to meet legal/accounting obligations.
Documents & storage
Uploaded documents are stored in a private storage bucket, accessed only by ClaimGuard staff to work your claim (via short-lived signed links). We do not make them public.
Electronic records
We rely on electronic records and signatures (e-signed agreements, uploaded documents, digital communications, PDFs, electronic notices). These are retained as business and claim records and have the same effect as paper originals to the extent permitted by law.
Who we share with
Service providers — Supabase(database & document storage), Resend (email), Vercel (hosting), Stripe (if you pay) — each processing data only to provide their service. Brokers/debtors, factors, and their agents — to pursue your claim, as you authorize. Independent counsel — only if you consent to escalate a claim. Public FMCSA data is queried for verification. We do not sell your personal information.
Data & document retention
We retain claim records, recovered-funds accounting, communications, and documents as needed to provide the service and to meet legal, tax, and accounting obligations. We retain claim records, recovered-funds accounting, and related documents for seven (7) years after closure of a claim (aligned with tax and business record periods), then dispose of them securely. Carrier accounts inactive for 6 months are removed, except where you have an open claim or funds owed.
Email outreach & opt-out
Outreach emails include our mailing address and an opt-out (reply STOP / unsubscribe). We honor opt-outs.
Security
Passwords are hashed; sessions expire after 30 minutes of inactivity; documents are private. No system is perfectly secure, but we take reasonable measures.
Your privacy rights
You may, at any time, ask us to: access the personal information we hold about you; correct inaccurate information; delete your account and associated personal data (except records we must keep for an open claim, funds owed, or legal/tax obligations); and opt out of outreach emails. Email info@jkissllc.com and we will respond within a reasonable time (generally within 30–45 days). We will not discriminate against you for exercising these rights. Residents of California and certain other states may have additional rights under state law; contact us to exercise them.
